Psychotherapy Excellence Limited trading as PESI UK (“PESI”, “we,” “our, or “us”) respects your privacy and is committed to protecting it through our compliance with this privacy notice.
This Privacy Notice (our “Privacy Notice”) describes the types of information we may collect, use, maintain, protect, disclose, or otherwise process about you when you visit our websites, including https://www.pesi.co.uk/ and its respective subdomains not covered by another privacy notice (each, a “Website”), install and use our mobile or desktop applications that you download from an authorized distribution site, such as the Apple App Store® or the Google Play Store® (each, an “Application”), and/or register for or attend one of our events (each, an “Event” and collectively with the Websites and Applications, the “PESI Services”) and our practices for collecting, using, maintaining, protecting, disclosing, or otherwise processing that information.
This policy applies to information we collect:
- on our Websites;
- when you register for or attend an Event;
- on or through our Applications;
- in email, text, and other electronic messages between you and PESI through any medium;
- when you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy;
- any other information we may collect about you offline when you use the PESI Services.
It does not apply to information collected by:
- us or any of our affiliates or subsidiaries related to your or any other individual’s employment or potential employment with us; or
- any third party, or our affiliates and subsidiaries, including through any application or content (including advertising) that may link to or be accessible from the Websites or Applications.
Unless otherwise defined in this Privacy Notice, any terms defined in the United Kingdom’s Data Protection Act and United Kingdom General Data Protection Regulation), (collectively, the “GDPR”) have the same meaning when used in this Privacy Notice.
Please read this Privacy Notice carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the PESI Services. By accessing or using the PESI Services, you agree to this Privacy Notice. 2. Data Controller
PESI is the data controller of your Personal Data.
3. Children Under the Age of 18.
The PESI Services are not intended for children under 18 years of age. No one under age 18 may provide any information on or through the PESI Services. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not use or provide any information on or through the PESI Services or on or through any of their respective features, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information directly from a child under 18, please contact us at the contact information listed below.
4. Information We Collect About You and How We Collect It.
Throughout this Privacy Notice, the term “Personal Data” means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or device. However, Personal Data does not include any deidentified, aggregated, or anonymized information.
Generally
We collect Personal Data from various sources, including:
- directly from you when you provide it to us or to a third-party on our behalf;
- automatically as you navigate through or otherwise use the PESI Services;
- information that we create about you as you use the PESI Services; and
- from third parties, for example, our business partners.
Information You Provide to Us
We collect the following types of Personal Data directly from you when you access or use the PESI Services or provide it to a third party service provider operating on our behalf: real name, alias, postal address, unique personal identifier, email address, telephone number, any other identifier by which you may be contacted online or offline, title, and professional, license and certification information. Our payment processor directly collects your credit or debit card number or other financial information when you make a purchase on our Websites or through our Applications, but we only receive tokenized versions of this information that cannot be used by third parties to make other purchases and are only used for recordkeeping purposes and to process subscriptions/refunds if necessary. In addition, we also collect other types of information that you may provide when you fill out a form or through your correspondence with us.
The Personal Data we collect on or through our PESI Services includes:
- information that you provide by filling in forms on our PESI Services. This includes information provided at the time of registering to use the PESI Services or making a purchase on or through the PESI Services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the PESI Services;
- if you contact us, records and copies of your correspondence (including email addresses);
- your responses to surveys that we might ask you to complete for research purposes;
- details of transactions you carry out through the PESI Services and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the PESI Services; and
- your search queries on the Websites or Applications.
You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the PESI Services or transmitted to other users of the PESI Services or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the PESI Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Websites or Applications, we may use automatic data collection technologies to collect certain Personal Data about your interaction with our Websites or Applications, including information about your equipment, browsing actions, and patterns. This includes:
- details of your visits to, and use of, the Websites or Applications, including browsing history, search history, traffic data, location data, logs, referring/exit pages, date and time of your visit to our Websites or use of the Applications, error information, clickstream data, and other communication data and the resources that you access, use, or otherwise interact with on or through the Websites or Applications;
- your apparent general physical location based on your IP address and other similar network information, which may identify your location to a general region, such as country, state, city/town, but not provide specific, precise location; and
- information about your computing device and internet connection, i.e., your IP address, operating system, device make and model, and browser type.
The information we collect automatically may include Personal Data or we may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. It helps us to improve the PESI Services and to deliver a better and more personalized service by enabling us to:
- estimate our audience size and usage patterns;
- store information about your preferences;
- provide you with targeted advertising, which is based on your activities on the PESI Services and other online activities;
- record your activities on our Websites and Applications for analytics and debugging purposes;
- customize the PESI Services according to your individual interests;
- speed up your searches; and
- recognize you when you return to our Websites or Applications.
The technologies we use for this automatic data collection may include:
- Cookies (or browser cookies). A cookie is a small file stored on your computer. When required by applicable law, we only place non-essential cookies on your device with your consent. - Website or Application Interaction and Performance Monitoring Tools. Our Websites and Applications may also use interaction and/or performance monitoring tools (sometimes call tracking scripts, analytics tools, session replay tools, or heatmap tools). These tools execute code in your web browser or on your device to help us collect data about your use of and interactions with the pages and content on our Websites and/or Applications. This may include recording your mouse movements, keystrokes, navigation pathways, other actions that you take our Websites or Applications, and information automatically transmitted from your web browser to our Websites or about your use of the Applications such as information about your operating system, computer hardware, and browser preferences. We may collect Personal Data from third parties. When we associate this information with other Personal Data about you, we consider this information to be Personal Data. This information includes: name, postal address, email address, telephone number, and title.
5. Automated Decision Making
PESI does not use your Personal Data with any automated decision making process, including profiling, which may produce a legal effect concerning you or similarly significantly affect you.
6. How We Use Your Information.
We process your Personal Data for the following purposes:
- to provide and personalize the PESI Services and its content to you;
- to provide you with information, products, or services that you request from us;
- to communicate with you regarding the specific Event for which you registered, for our internal reporting purposes relating to the Event, and as necessary for the management and organization of the specific Event for which you registered;
- to support, develop, troubleshoot, and debug the PESI Services;
- to create, maintain, customize, and secure your account with us;
- to process your requests, purchases, transactions, and payments and prevent transactional fraud;
- to provide you with notices about your account, including expiration and renewal notices;
- to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses;
- to personalize your PESI Services experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and advertisements through the PESI Services, third-party sites, direct mail, and via email or text message (with your consent, where required by law);
- to help maintain the safety, security, and integrity of the PESI Services, products and services, databases and other technology assets, and business;
- for internal testing, research, analysis, and product development, including to develop and improve our Website, and to develop, improve, or demonstrate our products and services;
- detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
- debugging to identify and repair errors that impair existing intended functionality;
- to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
- for accreditation and regulatory compliance purposes;
- to notify you about changes to the PESI Services or any products or services we offer or provide through them;

- for any other purpose with your consent.
We may further deidentify, anonymize or aggregate your Personal Data in accordance with applicable law such that it can no longer reasonably be used to identify you and use it without restriction.
We may also use your Personal Data to contact you about our own and third-parties’ goods and services that may be of interest to you. 7. Lawful Basis for Processing Your Personal Data
We rely on the legal bases below for our processing activities (except when an exception applies as described below):
- Consent. Sometimes, we will use your Personal Data because you have actively indicated it is okay that we do so. This includes, for example, situations where you have checked a consent box when required to be made available to you under applicable laws;
- Legitimate Interests. We will process your Personal Data as necessary for our legitimate interests. Our legitimate interests are balanced against your interests and rights and freedoms and we do not process your Personal Data if your interests or rights and freedoms outweigh our legitimate interests. Our legitimate interests include to: facilitate communication between PESI and you; detect and correct bugs and to improve our Websites and Applications; safeguard our IT infrastructure and intellectual property; detect and prevent fraud and other crime; promote and market our business; check your credit and perform risk assessments; and develop our product and services;
- To Fulfill Our Obligations to You under our Contract. We process your Personal Data in order to fulfill our obligations to you pursuant to our contract with you to deliver our goods and services to you;
- As Required by Law. We may also process your Personal Data when we are required or permitted to by law; to comply with government inspections, audits, and other valid requests from government or other public authorities; to respond to legal process such as subpoenas; or as necessary for us to protect our interests or otherwise pursue our legal rights and remedies (for instance, when necessary to prevent or detect fraud, attacks against our network, or other criminal and tortious activities), defend litigation, and manage complaints or claims.
8. Disclosure of Your Personal Data.
In order to provide the PESI Services to you, we may send and store your Personal Data outside of the European Economic Arena (“EEA”), Switzerland, or the United Kingdom, including to the United States. Accordingly, your Personal Data may be transferred outside the country where you reside or are located, including to countries that may not or do not provide an equivalent level of protection for your Personal Data. Your information may be processed and stored in the United States and United States federal, state, and local governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through the laws of the United States.
When your Personal Data is safeguarded by the GDPR, before sending it to parties outside the EEA, the United Kingdom, or Switzerland, we will do one of two things:
- Seek your consent; or
- Demand privacy and security: We will ensure the third party maintains the same level of privacy and security for your Personal Data as we do.
In some cases, the authorities of a country may have determined that the laws of other countries, territories or sectors within a country provide a level of protection equivalent to domestic law.
We are accountable for the protection of your Personal Data when we transfer it to others. We either send it to a country, territory or sector within a country that is recognized as providing the same level of personal data protection as the country of origin, or use safeguards like the Data Privacy Framework, Binding Corporate Rules or the Standard Contractual Clauses (also known as the “SCCs”) approved by the European Commission under Article 46.2 of the GDPR, with necessary adjustments for transfers from the United Kingdom or Switzerland, or use specific transfer instruments like the United Kingdom International Data Transfer Agreement.
We may disclose Personal Data that we collect or you provide as described in this Privacy Notice:
- to our subsidiaries and affiliates;
- to contractors, service providers, and other third parties we use to support our business. These entities provide IT and infrastructure support services, payment processing services, and other similar services we use to run our business. - to co-organizers of an Event as reasonably necessary for the management and organization of the Event for which you registered;
- to contractors and service providers providing services for the Event you are attending. In particular we may share your information (including dietary requirements and disability information) with venues and catering service providers, to ensure appropriate accommodations.
- to Event sponsors, if we are legally permitted or have your consent or another legal basis to do so;
- to other attendees of an Event, but in limited situations and only if we are legally permitted to do so or have your consent or another legal basis to do so;
- to a potential or actual buyer or other successor in the event of a planned or actual merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of PESI, Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by PESI, Inc. about the users of our PESI Services is among the assets transferred;
- to third parties to market their products or services to you if you have not opted out of these disclosures (or if you have consented, where required). For more information, see Choices About How We Use and Disclose Your Information;
- to third-party cookie and other tracking technology providers for the purpose of providing analytics (including information about your access and viewing of streaming content provided by us, when applicable) and advertising services to us;
- to fulfill the purpose for which you provide it;
- for any other purpose disclosed by us when you provide the information; and
- with your consent.
We may also disclose your Personal Data:
- to comply with any court order, law, or legal process, including to respond to any government or regulatory request;
- to enforce or apply our Terms of Use and other terms and conditions and agreements, including for billing and collection purposes; and
- if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of PESI, Inc., our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
9. Data Retention Periods
PESI will retain your Personal Data for as long as needed for the purpose we collected it and any other permitted linked purpose and in accordance with our data retention policies.
For example, we will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
We retain and use your Personal Data as required to meet legal obligations, resolve disputes, and enforce our agreements and policies. If we use your data for multiple purposes, we keep it until the purpose with the longest retention period expires, discontinuing use for shorter periods. Our retention periods align with our business needs and industry standards.
10. Offline Collection, Use, and Disclosure of Information.
The majority of information that we collect is obtained through our Websites and Applications. We also may collect information offline, where we also try to protect the privacy of your Personal Data. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the Personal Data we need in order to place the order or to answer the question. There are other ways we could learn of Personal Data offline, and this Privacy Notice does not discuss or try to predict all of those methods or uses. As we mentioned, we will try to treat offline collection, uses, and disclosures consistently with our relevant online practices.
11. Choices About How We Use and Disclose Your Information.
We strive to provide you with choices regarding the Personal Data we have collected about you. We have created mechanisms to provide you with control over your Personal Data:
- Tracking Technologies and Targeted and Behavioral Advertising. We may use certain tracking technologies, including cookies, to display advertising to you based on your activities on our Websites and Applications and other online activities. These technologies may also record your activities on our Websites, Applications, and your other online activities on the PESI Services, and such recordings may be disclosed and processed by third parties who provide such technologies. These functions help us understand our users and the use of the PESI Services. You may disable these technologies through our cookie consent manager, which you may access by clicking the “Cookies” link on the bottom of any page of our Websites or in the Applications and disabling our use of analytics or advertising cookies and similar technologies. - Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out. You may do so at any time by sending us an email stating your request through the contact information below.
- Promotional Offers from PESI. If you do not want us to use your contact information to promote our own or third parties’ products and services, you can opt-out by sending us your request at the contact information below. If we have sent you a promotional email, you may click the unsubscribe link in the body of that email to be omitted from future email distributions. This opt-out does not apply to information provided to PESI as a result of a product purchase, warranty registration, product service experience, or other transactions.
However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can learn more about interest-based advertisements and your opt-out rights and options from members of the Network Advertising Initiative (“NAI”) on its website (www.networkadvertising.org) and from members of the Digital Advertising Alliance on its website (www.aboutads.info).
12. Data Protection Rights.
Depending on where you live, and subject to certain exceptions, you may have some or all of the following rights set out below.
- Right to be Informed. You have the right to obtain from us all information regarding our data processing activities that concern you, such as how we collect and use your Personal Data, how long we will keep it, and who it will be shared with, among other things. We are informing you of how we process your Personal Data with this Privacy Notice. We will make every effort to let you know how we use your Personal Data. However, if we did not get your data directly from you, the GDPR does not require us to inform you in these cases: (1) When it is impossible or too costly to provide the information. (2) When the law obliges us to gather or share the data. (3) If the Personal Data must stay confidential because of professional or other secrecy obligations.
- Access. You have the right to (1) get confirmation of whether we process Personal Data about you (2) ask for full details of the Personal Data we hold about you and certain related information; (3) get a copy or access to the Personal Data. Under some circumstances, we may deny your access request. In that event, we will respond to you with the reason for the denial.
- Update. You can review, correct, and change your Personal Data by logging into the Websites and/or Applications and visiting your “Account” page. You may also notify us through the contact information below of any changes or errors in any Personal Data we have about you to ensure that it is complete, accurate, and as current as possible. We may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.
- Restrictions. You have the right to restrict our processing of your Personal Data under certain circumstances. In particular, you can request we restrict our use of it if you contest its accuracy, if the processing of your Personal Data is determined to be unlawful, or if we no longer need your Personal Data for processing but we have retained it as permitted by law.
- Right to Object. You have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data where we rely on legitimate interests. We will no longer process your personal data unless we demonstrate compelling legitimate grounds for processing or for the establishment, exercise, or defense of legal claims. You also have the right to object at any time to our use of your personal data for direct marketing purposes.
- Portability. To the extent the Personal Data you provide PESI is processed based on your consent and that we process it through automated means, you have the right to request that we provide you a copy of, or access to, all or part of such Personal Data in a structured, commonly used, and machine-readable format. You also have the right to request that we transmit this Personal Data to another controller, when technically feasible.
- Withdrawal of Consent. To the extent that our processing of your Personal Data is based on your consent, you may withdraw your consent at any time by closing your account. Withdrawing your consent will not affect the lawfulness of the processing based on your consent before its withdrawal and will not affect the lawfulness of our continued processing that is based on any other lawful basis for processing your Personal Data.
- Right to be Forgotten. You have the right to request that we delete all of your Personal Data. We cannot delete your Personal Data except by also deleting your user account, and we will only delete your account when we no longer have a lawful basis for processing your Personal Data or after a final determination that your Personal Data was unlawfully processed. We may not accommodate a request to erase information if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. In addition, some data may rest in previous backups retained per our disaster recovery policies.
- Complaints. You have the right to lodge a complaint with the applicable supervisory authority in the country you live in, the country you work in, or the country where you believe your rights under applicable data protection laws have been violated. In the United Kingdom, you can submit a complaint with the Information Commissioner’s Office. Before lodging a complaint, we request that you contact us directly to give us an opportunity to resolve any concerns.
- How You May Exercise Your Rights. You may exercise any of the above rights by contacting us through any of the methods listed under Contact Information below. We may ask you for additional information to verify your identity. We reserve the right to limit or deny your request if you fail to provide sufficient information or if required to satisfy our legal and business requirements. If you make unfounded, repetitive, or excessive requests, a fee may apply, subject to applicable law.
Verification and Authorized Agents
Before we fulfill your request to access, correct, or delete your Personal Data (or any other privacy-related request we receive), we may ask you to provide information that matches the details we already have on file. This could include confirming your name, email address, or other account details. We do this to ensure that only you (or an authorized agent you designate) can access or modify your Personal Data.
If you choose to submit a request through an authorized agent (such as a legal representative or other designated individual), we may require:
